1. About these terms

These Terms of Service ("Terms") govern your use of the Vocal Edge mobile app and vocaledgeapp.com, including the tongue twister test (the "Service"). The Service is operated by Snake Charmer Limited, Ballycordrea, Old Tramore Road, Waterford, Ireland ("we", "us" or "our").

By using the Service, you agree to these Terms. If you do not agree, do not use it. You must be at least 16 to use Vocal Edge and have legal capacity to enter into this agreement or permission from a parent or guardian where required. Our Privacy Policy explains how we handle personal data.

2. What the Service provides

Vocal Edge provides English pronunciation lessons, listening examples, visual sound guides, recorded speech assessment, practice recommendations, progress tracking and speaking challenges. Some features are free; others require a registered account and an active subscription. Available features and reasonable usage limits are shown in the Service.

Speech assessment requires a working internet connection and microphone access. Automated feedback uses American English as a reference and can be affected by your recording, device, background noise and the speech service. We do not guarantee a particular score, improvement, accent change or educational or employment outcome. Scores are practice guidance, not a recognised qualification or a judgement of your ability or identity.

Vocal Edge is an educational tool, not speech therapy or a medical service. It does not diagnose or treat speech, hearing or other health conditions.

3. Accounts and guest access

Provide accurate information, keep your credentials secure and tell us if you suspect unauthorised access. You are responsible for how you use your account. Do not share credentials or impersonate another person.

Guest access allows limited practice without registering. Guest progress is temporary and may be lost when a session expires, local data is cleared or an inactive guest account is removed. Create an account to keep your learning history across sign-ins.

4. Subscriptions, billing and cancellation

• The purchase screen and Apple’s confirmation show the price, billing period and included access before you subscribe. Prices can vary by country and applicable taxes. We do not promise a trial or introductory offer unless it is displayed and you are eligible.
• Payment is charged to your Apple account when you confirm the purchase, subject to any displayed trial. Subscriptions renew automatically unless cancelled at least 24 hours before the current period ends. Apple may charge for renewal within the 24 hours before that period ends.
• If an eligible trial is offered, it converts to the displayed paid subscription unless you cancel at least 24 hours before the trial ends. Apple’s purchase confirmation governs any offer conditions.
• Manage or cancel a subscription in your Apple account’s subscription settings. Cancellation normally takes effect at the end of the paid period, subject to the store’s terms. Deleting your account or uninstalling the app does not cancel a subscription.
• Use Restore access on the subscription screen to restore an eligible purchase. Refund requests are handled through Apple and applicable consumer law; nothing in these Terms removes your statutory rights.
• Changes to subscription prices or billing are handled through the store’s notice and consent processes where required.

5. Acceptable use

• Use the Service lawfully and respect other people’s privacy and intellectual property.
• Submit only recordings you are entitled to provide. Do not record another person without appropriate permission or include unnecessary sensitive information.
• Do not bypass subscription or usage limits, interfere with the Service, introduce malicious code, attempt unauthorised access or use automated requests to abuse the Service.
• Do not copy, resell or distribute our lessons, reference audio, artwork or software except as these Terms, an applicable licence or law permits.

6. Your recordings and our content

You retain any rights you hold in your recordings and other submitted content. You grant us a limited, non-exclusive permission to process that content and use our service providers to deliver the features you request, including assessment and optional saved playback. This does not transfer ownership of your voice or give us permission to publish your recordings for marketing.

Our software, branding, lessons, reference recordings and illustrations belong to Snake Charmer Limited or its licensors. We grant you a limited, personal, non-transferable licence to use them through the Service while you comply with these Terms and hold any required subscription. Applicable open-source licences remain in effect.

For the iOS app, Apple’s Standard Licensed Application End User License Agreement also applies to the app licence. These Terms govern our Service and do not replace Apple’s store terms or limit any rights they give you.

7. Availability and changes

We use reasonable care and skill to provide the Service, but cannot promise uninterrupted availability or error-free assessments. Maintenance, network conditions and third-party outages may affect access. We may update content or features for improvements, security, compatibility or legal reasons.

If we make a material change that adversely affects paid access, we will give appropriate notice and honour any cancellation, refund or other remedy required by applicable law.

8. Responsibility and consumer rights

Nothing in these Terms excludes or limits liability for fraud, fraudulent misrepresentation, death or personal injury caused by negligence, or any other liability or consumer right that cannot lawfully be excluded or limited.

Subject to those protections, we are responsible for loss or damage that is a foreseeable result of our breach of these Terms or failure to use reasonable care and skill. We are not responsible for business losses arising from your use of this personal learning service, or for losses that were not reasonably foreseeable. You retain all mandatory rights relating to digital content and services, including remedies where they are not supplied as agreed.

9. Ending access and deleting your account

You can stop using the Service at any time and delete your account through Settings → Delete account and data. This removes your learning history and saved recordings as described in the Privacy Policy. Cancel any Apple subscription separately.

We may restrict or suspend access for a serious breach of these Terms, security risks, abuse or legal requirements. Where reasonable and lawful, we will explain the reason and allow you to resolve the issue. Any action remains subject to your statutory rights and applicable subscription remedies.

10. Changes to these Terms

We may revise these Terms to reflect changes to the Service, law or how we operate. We will update the date and give notice of material changes through the website or app before they take effect where required. Changes do not retrospectively remove rights you already have. If you do not agree to a change, you may stop using the Service and cancel renewal of a subscription; any statutory remedies remain available.

11. Governing law

These Terms are governed by Irish law. If you are a consumer, you also retain the mandatory protections of the law of the country where you habitually live and any right to bring proceedings in your local courts. No provision requires you to give up those protections. If a provision is unenforceable, the remaining provisions continue to apply.
